Obligations − Owner or administrator rights

  1. The owner or manager of the building or their legal representative is responsible, in addition to assigning maintenance to a responsible maintenance contractor, for the following:

a) To ensure the periodic inspection of the elevator, its initial certification by a recognized inspection body for elevators in cases III and IV of paragraph 2 of article 3 of this article, and its periodic re-inspection.

b) To report to the responsible maintenance contractor any operating anomaly that occurs.

c) To keep a copy and monitor the elevator file and to maintain the maintenance booklet, of which he is the legal owner, certified by the competent service of the Prefectural Government.

d) To ensure the existence and proper functioning of the emergency notification device.

  1. If the owner or manager wishes to change the maintenance team, he is obliged to notify the team in writing, by registered letter, at least twenty (20) days before the change and during this period to assign the maintenance to a new team. In any case of taking over the maintenance by a new responsible maintainer, all the necessary codes for the operation of the elevator must be delivered in writing to the owner or manager of the building or their legal representative by the outgoing maintainer in order to ensure its smooth and safe operation.
  2. The new takeover is declared by responsible declarations of the law. 1599/1986 of the new maintainer (in duplicate), and of the owner or manager of the building, legally certified as an original signature, to the competent Service of the Prefectural Government, presenting the elevator maintenance book, in which the new assignment and undertaking will be registered, as well as the license of the elevator maintenance workshop. A copy of the responsible declaration of undertaking the maintenance is forwarded to the Development Directorate of the Prefectural Government of the headquarters of the maintainer in order to update the register of elevator maintenance workshops.
  3. The owner or manager of the building or their legal representative may not assign the repair or other work on the elevator to persons other than the responsible maintainer.
  4. The owners or managers or their legal representatives may, for safety reasons, arrange for a telephone connection of the elevator cabin to a telecommunications service provider.
  5. In the case of public elevators, the existence and operation of an emergency call device becomes mandatory from 1.7.2009.
