Maintainer obligations

  1. (a) In order to ensure the correct and responsible execution of elevator maintenance work, the responsible maintainer of the workshop or workshops carries out the relevant maintenance checks every four (4) months for the elevators of paragraph 4(a) and (b) of article 4, and every three (3) months for the elevators of paragraph 4(c) of article 4 and updates the maintenance booklet in the corresponding position.
    (b) The maintenance booklet, which is considered by the Development Directorate of the relevant Prefectural Government only during the initial registration phase, lists the obligations of the maintainer and the sanctions provided for and records the full details of the lift, the maintainer and the respective inspection body. The booklet records all significant actions on the lift (inspections, maintenance and changes in maintenance, modifications, accidents, instructions from the maintainer to the owner or manager or their legal representative and any
    other relevant details for monitoring the history of the lift) and must be available upon request of the Authorities and the recognized bodies during extraordinary or periodic inspections. The endorsement during the registration phase does not legalize the content of the booklet which is the responsibility of the maintainer.
  2. The responsible maintenance person is present and updates the maintenance booklet in all cases of repair of serious damages, replacement and alteration of components and elements of the elevator. The responsible maintenance person must be present during the periodic inspection of an elevator and assist in its conduct.
  3. The responsible maintainer is obliged to be present after a written summons during the carrying out of extraordinary inspections in the context of complaints or accidents in accordance with article 11 of this decision. The services provided, within the framework of this paragraph, do not entail any financial burden on the owner or manager of the building where the elevator is installed.
  4. The responsible maintainer shall ensure and inform the owner or manager or their legal representative of the necessary repairs and take necessary measures, always in accordance with the provisions in force at the time of installation of the elevator. In particular, in the event that the owner or manager or their legal representative does not comply with the instructions of the responsible maintainer for repairs or taking necessary measures on the elevator and a risk is caused to the safety of users, he is obliged to interrupt the operation of the elevator in question and at the same time inform, justifying the interruption, the above owner or manager or their legal representative and the Development Directorate of the relevant Prefectural Government in order to proceed with the inspection and the necessary actions in accordance with article 12 of this decision. It may also terminate its cooperation with the owner or manager or their legal representative and the latter may assign the maintenance of the elevator to another responsible maintainer in accordance with the procedure provided for in paragraph 2 of article 8 of this decision. In the event that the owner or manager or their legal representative does not agree with the assessment of the maintainer, it has the right to address a control body of his choice or a special expert of the Technical Chamber of Greece, who is obliged within 60 days to give a final opinion on the issue that has arisen, and the Development Directorate of the relevant Prefectural Government to implement the provisions of the opinion. In the event of a final disagreement between the maintainer and the owner or manager or their legal representative, the termination of the cooperation must take place within twenty (20) days of this finding.
  5. The responsible maintainer is obliged to inform the respective owners or managers in writing of their obligation to assign the inspection (initial, periodic, regular, after an accident, after serious modifications or replacements of elements, components, mechanisms or even use of the elevator) to a recognized elevator inspection body.
  6. The responsible maintainer is obliged, upon undertaking maintenance, to deliver a certified copy of the maintenance workshop license issued in his name to the owner or manager or their legal representative.
  7. The elevator maintenance workshop manager must maintain the following:

(a) Book – register of elevators, paginated and certified by the Development Service of the Prefectural Government, in the area to which the head office of the maintainer belongs, in which the details of each elevator, the number of stops and the type of building, of which maintenance is undertaken or discontinued (Service file number, license number, inspection body, registration number, full building address) are entered.

(b) Maintenance logbook, paginated and certified as above, in which the maintenance carried out each day is recorded.

(c) Permanent headquarters with an automatic answering machine for reporting breakdowns 24 hours a day. The permanent headquarters is the same for all mobile workshops.

(d) Appropriate space and equipment of instruments and tools required for carrying out maintenance and inspections.

  1. In the event of the maintenance crew resigning from the maintenance of the elevator, it is obliged to inform, in writing, by registered mail at least twenty (20) days before the resignation, the owner or the manager or the person who replaces him in the management of the building and to submit the resignation within this period, with a Solemn Declaration of Law 1599/86, to the Development Directorate for updating the Register of maintenance crews.
  2. The responsible maintainer of the elevator is obliged to inform the owner or manager or their legal representative in writing, three (3) months before the expiry of the deadline, for the performance of the initial or periodic inspection in accordance with paragraph 1 of article 10 and paragraph 1 of article 15 hereof.
  3. In case of resignation or change of the person responsible for maintenance, it is necessary, in addition to the relevant responsible declarations of Law 1599/86 of the person responsible for maintenance and the owner or manager or their legal representative, to submit to the relevant Development Directorate of the Prefectural Government by the new maintainer, a list of elevators maintained by him as well as the regular maintenance program, 37084 GOVERNMENT GAZETTE (ISSUE SECOND) in order to ensure the requirement of paragraph 4 of article 5 regarding the maintenance limit of up to two hundred and forty (240) elevators.
