Maintenance Workshops

  1. Maintenance work on an elevator is carried out exclusively by a maintenance workshop, which has the required permit from the Development Directorate of the relevant Prefectural Government, has been registered in the maintenance register kept by this Directorate and has the appropriate instruments, means and personnel.
  2. Each license holder according to paragraph 1 (maintenance manager) has the right to manage (3) three mobile elevator maintenance teams.
  3. Each mobile elevator maintenance team must consist of at least one electrician of the 4th specialty and one assistant electrician of the 4th specialty or electrician of the 4th specialty. The responsible maintainer may be declared as a member of one of the teams, which he has the right to lead.
  4. Each mobile workshop can carry out the maintenance of up to two hundred and forty (240) elevators.
  5. The duration of the elevator maintenance must be at least forty-five (45) minutes or as long as required at the discretion of the maintenance workshop. The head of the maintenance workshop and the owner or manager or their legal representative supervise whether the above period of time is exhausted by the personnel of the said workshop.   6. The maintainers who have the right to install lifts in accordance with the applicable provisions for the classification of electrical and mechanical installations and the registration of professional rights, if they also carry out installations, may use the personnel of the mobile maintenance teams in installation work, provided that the foreseen number of 240 lifts that they can maintain in accordance with paragraph 4 of article 4 is not completed. This personnel must include, among others, a licensed installer of the 4th specialty. Licensed maintainers of the 4th specialty do not have the right to install lifts.
  7. In the event that it is proven that the minimum maintenance provided for herein for the specific type of elevator is not carried out, due to the maintenance worker’s negligence, or the minimum maintenance duration of forty-five minutes is not observed, the owner or manager may report to the competent Prefectural Service that has issued the maintenance workshop’s license and has it registered in the Register it maintains.
  8. In the event of an employment relationship between the maintainer and a legal entity, both the maintainer himself as a natural person and the legal entity on whose behalf he acts are jointly and severally liable for any obligation of the maintainer, whose representative must supervise the quality of the services provided by the natural person maintainer to the user of these services.
